Terms and Conditions
All orders are accepted and goods supplied by us on the following terms and conditions:
All prices shown in the catalogue are in GB Pounds and are Ex-works. We reserve the right to withdraw an item or amend a price where a printing error has occurred. Additional charges will apply for Export Packing, Carriage, Insurance or Freight. Our Export Sales Office will be happy to quote for any of these ancillary costs prior to despatch. (Incoterms 2011 apply).
Prices shown in this catalogue are exclusive of VAT. Orders received from outside the EU will not be subject to VAT providing delivery is also to be made to a NON-EU country. Orders from countries within the EU will be subject to VAT at the UK rate (currently 20%) unless a valid VAT number is provided. Any Zero-VAT invoices where delivery is to a UK Freight Forwarder, we must receive a certificate of shipment within three months of invoice date. Failure to do so will result in an invoice being raised to cover the cost of the VAT.
3. Quantity Rates
Quantity prices only apply to orders for the specific quantity or more. Pack prices apply only to single or multiple packs. All small or broken pack quantities are charged at the higher rate applicable to small quantities.
4. Quotations and Invoices
Quotations are subject to confirmation at the time of the receipt of the order, and we reserve the right to amend any accidental errors/omissions on quotations or invoices. Whenever possible (and unless stated) we will hold prices stated on quotations firm for a period of twenty eight days.
No liability whatsoever can be accepted in cases of non-delivery or delayed delivery. Deliveries offered ‘ex-stock’ are subject to the goods being unsold at the date of the receipt of the customer’s order.
No condition is made or to be implied, nor is any warranty given or to be implied as to the life or wear of the goods supplied, or that they will be suitable for any particular purpose or for use under any specifications. Users are advised to test and examine goods and/or to exercise special care in cases where the use and/or storage of the goods involve danger to persons and/or property.
7. Sale of Poisons & Chemicals
The sale of listed poisons is restricted by the Pharmacy and Poisons Act (1933) and by the Poisons Rules. We supply poisons only to persons requiring them (a) for use or for resale in trade or business, or (b) for scientific education or research. For the purchase of these poisons written order on user’s official order from signed by the purchaser, stating his name, address, trade, business or profession and purposes for which the poison is required. We do not supply private individuals with chemicals.
8. Amendments to or Cancellation of Orders
Sympathetic consideration will be given to all requests for amendments to, or cancellation of orders, or to requests for credit against goods returned. However, such amendments, cancellations or returns must be by prior agreement by us and we reserve the right to make a handling charge if necessary.
9. Trade Descriptions Act 1968
All descriptions, illustrations etc. are intended to convey a general description of the goods offered. However, due to our policy to improve goods whenever possible, specifications are subject to alterations without notice, and we accept no responsibility for any loss caused by such alterations having been made, provided the product is of comparable quality.
10. Terms of Payment
Payment terms for all export customers will be on a case by case basis and negotiated and agreed at the time of order. Thereafter the Seller shall be entitled to recover interest on any unpaid amounts at 8% above the base rate of the Royal Bank of Scotland ruling at the date the purchase price is due. Goods remain the property of the Seller until payment in full is received. Either a remittance or two approved trade references and a Bankers’ reference should accompany orders from customers who have no previous account. Payment can only be accepted in GBP by sterling cheque, bank transfer or credit card.
11. Carriage and Freight
For International Orders the freight rates quoted will be valid for as long as the validity of the original quotation.
12. Damage and/or Loss in Transit
Please notify us within 10 working days of any items damaged in transit OR if your delivery fails to arrive. Claims outside this period may not be accepted. In the event of a problem, please contact our Export Team, who will be happy to assist and advise how to proceed. No responsibility is accepted for breakage or loss in transit unless insurance has been arranged by ourselves. In all cases it is the customer’s responsibility to arrange third party insurance for goods in transit unless otherwise agreed in writing.
13. Shortage or Errors
No claim can be entertained unless we are notified within 10 days of receipt of goods.
14. Returning Goods
Timstar will not accept returned goods without prior authorisation. Goods deemed ‘no longer required’ will need to be returned in a re-saleable condition and at your own expense. Please contact our Export Team for advice in every instance.
15. Title to Goods
The goods remain the property of Timstar Laboratory Suppliers Ltd. until payment of the appropriate invoice has been received.
16. Electrical Equipment
All electrical goods will be supplied fitted with a UK plug so an adapter may need to be purchased separately in order for the item to work in the country of destination. No part of this Catalogue may be reproduced without prior permission of Timstar Laboratory Suppliers Ltd. E & OE.
