Terms and Conditions

All orders are accepted and goods supplied by us on the following terms and conditions:

 

1. Prices

All prices, whether quoted or given in our catalogues or prices lists are exworks only, and are subject to alteration without notice.We reserve the right to invoice goods at the prices ruling at time of despatch from our premises.

 

2. V.A.T.

All prices are subject to V.A.T. Ruling at time of despatch.

 

3. Quantity Rates

Quantity prices only apply to orders for the specific quantity or more. Pack prices apply only to single or multiple packs. All small or broken pack quantities are charged at the higher rate applicable to small quantities.

 

4. Quotations and Invoices

Quotations are subject to confirmation at the time of the receipt of the order, and we reserve the right to amend any accidental errors/omissions on quotations or invoices. Whenever possible we will hold prices stated on quotations firm for a period of twenty eight days.

 

5. Delivery

No liability whatsoever can be accepted in cases of non-delivery or delayed delivery. Deliveries offered ‘ex-stock’ are subject to the goods being unsold at the date of the receipt of the customer’s order.

 

6. Responsibility

No condition is made or to be implied, nor is any warranty given or to be implied as to the life or wear of the goods supplied, or that they will be suitable for any particular purpose or for use under any specifications. Users are advised to test and examine goods and/or to exercise special care in cases where the use and/or storage of the goods involve danger to persons and/or property.

 

7. Sale of Poisons & Chemicals

The sale of listed poisons is restricted by the Pharmacy and Poisons Act (1933) and by the Poisons Rules. We supply poisons only to persons requiring them (a) for use or for resale in trade or business, or (b) for scientific education or research. For the purchase of these poisons written order on user’s official order from signed by the purchaser, stating his name, address, trade, business or profession and purposes for which the poison is required. We do not supply private individuals with chemicals.

 

8. Cancellations & Returns

Customers must contact Timstar within 30 days of delivery to obtain authorisation to return any Goods. Goods returned by the Customer without prior authorisation will not be credited. Timstar reserves the right to charge the Customer a minimum of £15 to cover any collection and restocking costs it may incur as a result of a customer ordering error.* Customers must return all products unused and in their original boxes and packaging, including any manuals, software or accessories supplied with the products. Computer software and consumables (discs, cartridges, cassettes etc) can only be returned if the original packaging is unopened and any seals intact. Failure to follow these guidelines may invalidate any claim. Timstar cannot accept returns on certain products that are made to order, assembled prior to delivery or assembled and installed, unless they are faulty. *Collection charges for Chemicals ordered in error may be subject to a quote. 9. Trade Descriptions Act 1968

All descriptions, illustrations etc. are intended to convey a general description of the goods offered. However, due to our policy to improve goods whenever possible, specifications are subject to alterations without notice, and we accept no responsibility for any loss caused by such alterations having been made, provided the product is of comparable quality.

 

10. Terms of Payment

Prices are strictly nett for prompt 30-day payment and no deduction can be allowed. Thereafter the Seller shall be entitled to recover interest on any unpaid amounts at 8% above the base rate of the Royal Bank of Scotland ruling at the date the purchase price is due. Goods remain the property of the Seller until payment in full is received. Either a remittance or two approved trade references and a Bankers’ reference should accompany orders from customers who have no previous account.

 

11. Carriage

Unless otherwise agreed and stated in writing in respect of individual transactions, the Company reserves the right to make a charge for carriage, irrespective of the mode of delivery, on orders to the value of £75 or under. When a carriage charge is made, it will be shown on the invoice.

 

12. Damage and/or Loss in Transit

No responsibility is accepted for breakage or loss in transit when goods are forwarded by carriers. The carriers concerned and ourselves must be advised of all breakages in writing three days of the receipt of the goods and any packing material must be retained with the goods pending inspection by the carrier and/or ourselves. In the event of non-delivery both the carriers and ourselves must be notified in writing within fourteen days of date of advice or despatch. When consignments are forwarded by our own transport, no responsibility for breakage is accepted unless we are advised in writing within three days or receipt of goods.

 

13. Shortage or Errors

No claim can be entertained unless we are notified in writing within three days of receipt of goods.

 

14. Title to Goods

The goods remain the property of Timstar Laboratory Suppliers Ltd. until payment of the appropriate invoice has been received.

 

15. No Quibble Guarantee

If you are not satisfied in any way with the stock items you have received contact customer services on 03333 442 443, alternatively e-mail sales@timstar.co.uk within 30 days of the invoice date. They will be happy to assist with the arrangements for the return, refund or credit as applicable, providing the items are in a re-saleable condition.




International Terms of Business

 

All orders are accepted and goods supplied by us on the following terms and conditions:

All prices shown in the catalogue are in GB Pounds and are Ex-works. We reserve the right to withdraw an item or amend a price where a printing error has occurred. Additional charges will apply for Export Packing, Carriage, Insurance or Freight. Our Export Sales Office will be happy to quote for any of these ancillary costs prior to despatch. (Incoterms 2011 apply).

 

2. V.A.T.

Prices shown in this catalogue are exclusive of VAT. Orders received from outside the EU will not be subject to VAT providing delivery is also to be made to a NON-EU country. Orders from countries within the EU will be subject to VAT at the UK rate (currently 20%) unless a valid VAT number is provided. Any Zero-VAT invoices where delivery is to a UK Freight Forwarder, we must receive a certificate of shipment within three months of invoice date. Failure to do so will result in an invoice being raised to cover the cost of the VAT.

8. Amendments to or Cancellation of Orders

Sympathetic consideration will be given to all requests for amendments to, or cancellation of orders, or to requests for credit against goods returned. However, such amendments, cancellations or returns must be by prior agreement by us and we reserve the right to make a handling charge if necessary.

Thereafter the Seller shall be entitled to recover interest on any unpaid amounts at 8% above the base rate of the Royal Bank of Scotland ruling at the date the purchase price is due. Goods remain the property of the Seller until payment in full is received. Either a remittance or two approved trade references and a Bankers’ reference should accompany orders from customers who have no previous account. Payment can only be accepted in GBP by sterling cheque, bank transfer or credit card.

 

11. Carriage and Freight

For International Orders the freight rates quoted will be valid for as long as the validity of the original quotation.

 

12. Damage and/or Loss in Transit

Please notify us within 10 working days of any items damaged in transit OR if your delivery fails to arrive. Claims outside this period may not be accepted. In the event of a problem, please contact our Export Team, who will be happy to assist and advise how to proceed. No responsibility is accepted for breakage or loss in transit unless insurance has been arranged by ourselves. In all cases it is the customer’s responsibility to arrange third party insurance for goods in transit unless otherwise agreed in writing.

 

13. Shortage or Errors

No claim can be entertained unless we are notified within 10 days of receipt of goods.

 

14. Returning Goods

Timstar will not accept returned goods without prior authorisation. Goods deemed ‘no longer required’ will need to be returned in a re-saleable condition and at your own expense. Please contact our Export Team for advice in every instance.

 

15. Title to Goods

The goods remain the property of Timstar Laboratory Suppliers Ltd. until payment of the appropriate invoice has been received.

 

16. Electrical Equipment

All electrical goods will be supplied fitted with a UK plug so an adapter may need to be purchased separately in order for the item to work in the country of destination.

Starclub Loyalty Scheme: Terms and Conditions

 

1. General Starclub Loyalty Scheme Conditions

  • The Starclub Loyalty Scheme (the “Scheme”) and Starclub Loyalty Scheme associated clubs and benefits are operated by Timstar Laboratory Suppliers Limited, Unit 12, Ion Path, Road Three, Winsford Industrial Estate, Winsford, Cheshire, CW7 3BX.   • Timstar can cancel, withdraw or alter the scheme, including these Terms and Conditions, or any individual Starclub Loyalty Scheme account, at any time.
  • All Starclub Loyalty Schemes belong to Timstar.
  • The Starclub Loyalty Scheme is only valid for Schools based in the UK.
  • If we identify that you hold two or more Starclub Loyalty Scheme accounts, we may merge them into one account at our discretion.
  • Timstar can take any action it considers appropriate if we have reason to believe that you are abusing the scheme or associated clubs and offers.
  • Use of additional offers and benefits associated with your Starclub Loyalty Scheme account are subject to our discretion.
  • Members must register their details and keep Timstar informed of any changes. Timstar cannot be held responsible for any loss of points or vouchers incurred as a result of out of date details.
  • Accounts not active for over 12 months will be removed and any points or vouchers forfeited.
  • A person who is not a party to these terms and conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions, but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

 

2. Data Protection

We will only share your details with companies in the Wall Family group of companies. We will not disclose your data to any third parties unless we are required or permitted to do so by law (for example, law enforcement agencies). We will analyse your purchase history to provide you with relevant and personalised offers, information and advice.

 

3. Collecting Starclub Loyalty Scheme Points

  • After shopping online on www.timstar.co.uk your points will automatically be uploaded onto your Starclub Loyalty Scheme account within 5 days of your products being dispatched.
  • Online points promotions may not be available or may vary. Check individual promotion details.
  • Timstar reserves the right to withdraw points promotions/offers without notice.
  • The Starclub Loyalty Scheme, is not transferable, cannot be copied and cannot be exchanged for cash. The points cannot be used against outstanding or part payment invoices.
  • Timstar may decide to cancel your Starclub Loyalty Scheme or remove a member from the scheme at any time where there is reasonable belief of: - Any abuse or attempted abuse of the scheme; - Any breach or attempted breach of these terms and conditions and / or those relating to the optional elements of the scheme; - Any behaviour relating to Starclub Loyalty Scheme or Timstar Ltd, by supplying false or misleading information.
  • Starclub Loyalty Scheme accounts, points and vouchers cannot be transferred, bought, sold or in any way traded.
  • Members can choose to leave the scheme at any time. By leaving the scheme members forfeit the right to any points or vouchers already accrued or issued.
  • Members will be required to quote the Starclub Loyalty Scheme code with an order to redeem points against ensuing orders.
  • Points collected on additional purchases linked to the main Starclub Loyalty Scheme member’s account will be credited to that account.
  • Timstar is entitled to remove points at any time if products are returned for any reason and a full or partial refund of the purchase price is given. This also applies to the exchange of products, unless the exchange is for products with an equivalent point’s value.
  • Points awarded at the time of the transaction or vouchers already issued may be removed or cancelled if Timstar determines that the points were collected in breach of these terms and conditions or were awarded in error. For the avoidance of doubt, any advice or actions of our staff that is contrary to these terms and conditions will not have the effect of changing these terms and conditions.
  • Members can redeem their points against ensuing orders.
  • Free carriage against Starclub Loyalty Scheme orders except for any products subject to surcharge.

 

4. Spending Starclub Loyalty Scheme Points

  • You must have enough points to cover the cost of the item; you cannot make a part payment of points towards a product or service.
  • Calculation of points is per item ordered and rounded down to the nearest £pound. The current conversion value of points is one point equals one penny. For example: 1 item at £7.59 each = 7 points (7 pence), if you were to buy 10 of the same item this would equate to 70 points.
  • We reserve the right to substitute or remove products and services available for points collection and redemption without notice.
  • When spending points you cannot pay with a mix of points and money in one transaction. Each transaction must be made with either points or money. Not to be used in conjunction with any other promotional offers or Framework Agreements. Excludes Data Logging and Batteries.
  • Delivery costs can only be paid for with points if items in the transaction are being paid for with points and you have enough points to cover the full cost of delivery.

 

5. Returning Goods

  • If you return a product for refund, we will deduct the number of points collected from your Starclub Loyalty Scheme account.
  • If a product you buy with points is faulty, please return it to Timstar Laboratory Supplies Ltd. If necessary we will re-credit your account with the right number of points. No cash refund will be given in these circumstances.
